Plaintiffs from all over the nation filed lawsuit and claims that the drug caused kidney failure and a condition called diabetic ketoacidosis, which is caused by the buildup of acids in the blood. Due to the increasing number of case over the diabetes drug Invokana plaintiffs from Philadelphia Court of Common Pleas filed a petition with the court on Sept. 23rd are seeking to consolidate the action at the federal and state court level into a mass tort program. Currently, 87 cases are pending in Philadelphia, the invokana lawsuits have same allegations, Consolidating them would cut down on legal costs, provide opportunity for all plaintiffs to receive damages and increase efficiency.
The action came not exactly a week after a New York attorney filed a motion with the U.S. Judicial Panel on Multidistrict Litigation appealing that body to consolidate federal claims in the Trenton Division of the U.S. District Court of the District of New Jersey. More than 52 Invokana lawsuit is pending in 11 federal district courts including California, New Jersey, New York Georgia and Illinois. Consolidating them at the federal level would offer the same benefits as those mentioned in the proposed mass tort program. The movement prompted that the best place for the MDL would be New Jersey government court. Since Judge Brian R. Martinotti is as of now directing 36 Invokana cases, the motion asked for him to lead the pending cases.
Invokana (canagliflozin) is one of several “new generation” type 2 diabetes drugs known as SGLT2 inhibitors approved on March 29, 2013 by U.S Food and Drugs Administration. The drug inhibits normal kidney function to allow patients to pass excess blood glucose through urination. It is manufactured by Janssen Pharmaceuticals, a division of Johnson & Johnson. Janssen also markets Invokamet, a combination of canagliflozin and metformin. Although Invokana was approved by the United States Food and Drug Administration it is associated with several life threatening complications includes: Diabetic Ketoacidosis or Acidosis, Kidney Failure or Kidney Complications, Heart Attack or Stroke, Urinary Tract Infections, Bone Fractures and Blood Infection. FDA advised that before prescribing Invokana or Farxiga, physicians and healthcare providers should screen patients for aspects that might incline them to kidney injury.
The drug’s manufacturer Janssen Pharmaceuticals, a subsidiary of corporate giant Johnson & Johnson, actively defended its product and failed to provide adequate warnings and communications to the medical community and end line consumers of the increased risk of serious and life threatening medical complications associated with these drugs. According to FDA warning patients should not stop or change their diabetes medicines without first talking to their health care professional. Doing so can lead to uncontrolled blood sugar levels that can be harmful. Over time, this can cause serious problems, including blindness, nerve and kidney damage, and heart disease. Healthcare professionals and patients are encouraged to report adverse events or side effects related to the use of Invokana medication. It will help FDA for further investigations as well as in clinical trials.
There are many advantages and disadvantages of consolidated litigation, it provides greater uniformity for defendants and Litigation costs will be divided among class members. So it has Lower litigation costs. Class actions are most effective at generating large transaction costs in the form of legal fees that benefit both plaintiff and defense lawyers but it has Lack of decision making control.
