Recently a woman from California won her lawsuit against American multinational pharmaceutical company Johnson & Johnson. According to 62-year-old Deborah Giannecchini she is on Stage IV ovarian cancer due to the use of J&J’s talc powder. The talc powder forced her to have her spleen, colon, uterus and ovaries removed. She used J&J’s baby powder for feminine hygiene for more than forty years. On 27th October after hours of debate the St. Louis jury awarded $65 million to the plaintiff for damages and $2.475 million for compensation. In additional Jurors also ordered co-defendant Imerys Talc America, Inc. to pay $2.5 million for damages. Allen Smith, the lawyer for Ms Giannecchini, claimed that the manufacturers marketed its heritage body powder as safe and effective for odor and moisture control and failed to warn users of the increased risk of ovarian cancer caused by using talc-based products for personal hygiene use.
According to a report Johnson and Johnson is facing 4,000 similar talc powder lawsuits which are pending in court and this year the company has already been ordered to pay out a total of over £100 million to an ovarian cancer survivor and a deceased woman family who died from ovarian cancer. As per the plaintiff family they sued the company not just for money, they are in it to save the lives of other and to force Johnson and Johnson to do the right thing. The doctor of Ms Giannecchini inform that she has an 80 percent chance of dying in the next two years as she is on the last stage of cancer. Ms Giannecchini states that the company was aware of almost 40 years of independent scientific studies which linked the use of their products to higher risk of ovarian cancer when the talc was applied in the genital area but the manufacturers have continued to design, manufacture and sell it product in the market.
Johnson & Johnson has lost more than $5 billion for legal settlements over its drugs and medical devices. In this lawsuit company is not in favor of jury verdict. Despite of adding label to the product clarified that there’s no scientific evidence linking their products with health problems. Billie Ray a jury of this verdict states that Johnson & Johnson products should feature a warning label to allow customers to decide whether they want to use the talc or not. As per the study done by Dr. Daniel Cramer in 1982, a 92 percent increased risk for ovarian cancer amongst women who used body powder in their genital area. It was the first epidemiological study of its kind on talcum powder use on female genital area, has since been augmented by some 22 additional studies focused on the same issue. Cancer is hard to study because it develops over a long period of time and is influenced by many factors, including genes, behaviors and environmental exposures.
