The U.S. Food and Drug Administration (FDA) have received hundreds of adverse event reports involving retrievable filters. Types of reports include device migration, filter fracture, embolization (movement of the entire filter or fracture fragments to the heart or lungs), perforation of the IVC, and difficulty removing the device. The risks associated with IVC filters are severe as well as life threatening and in some cases death. As per a study in the journal Cardiovascular Interventional Radiology published in 2012 reported 100% of Cook Celect and Gunther Tulip IVC filters perforated patients’ venal cava wall in less than 3 months after being implanted. The study also reported that 40% of the filters were tilted and out of position. Unfortunately, increased use of the devices has also resulted in increased concern over potential complications. The major risks associated with the device are future thrombosis, filter fractures, migrations, perforations, and tilting.

Recently a woman from California filed a personal injury and defective product liability lawsuit against Cook Celect IVC Filter. According to the lawsuit, the woman had been diagnosed with an extensive thrombosis (blood clot that developed in a vein deep in the body). She was implanted with a Cook Celect IVC filter at the Hoag Memorial Presbyterian Hospital in Newport Beach, California, on January 11, 2008. The IVC Filter made by Cook Celect injured her internal organs and she suffered serious injuries. She accuses the manufacturer of negligence for selling a defective medical device, failing to warn about side effects, and concealing safety risks. The lawsuit was filed on August 22, 2016.

According to the lawsuit she still had the Cook Celect IVC filter lodged in her body. On October 30, 2015 she went to Stanford University Medical Center for a checkup and came to know that two limbs and one arm from the device had broken off and lodged in the right side of her heart. The doctors were not able to remove the lodged parts of filter from her body. Doctors suggest that she requires ongoing monitoring “As long as the filter remains embedded in her vena cava, Plaintiff is at risk for future thrombosis, filter fractures, migrations, perforations, and tilting. She faces numerous health risks, including the risk of death and will continue to suffer from significant medical expenses, pain and suffering. She seeks compensatory and punitive damages in excess of $75,000.

Many plaintiffs across the nation have to live with embedded IVC filter throughout their life with the risk of further injury from the device lodged inside their body. The FDA safety communication states that the risk of device perforation greatly increased the longer the device stayed in the body and recommending they be removed after 39 days, but before 54 days.
